Decision No. 13/2023/QD-TTg promulgating the List of scraps permitted to be imported from abroad into Vietnam as raw materials for production.

On May 22, 2023, Le Minh Khai – the Deputy Prime Minister signed the Decision No. 13/2023/QD-TTg promulgating the List of scraps permitted to be imported from abroad into Vietnam as raw materials for production. This Decision comes into from June 1, 2023.

Accordingly, scraps permitted to be imported from abroad as raw materials for production includes: iron and steel scraps; plastic scraps and crumbs of plastic; paper scraps; glass scraps; non-ferrous metal scraps.

In particular, iron and steel scraps include: Cast iron scraps and crumbs of cast iron (HS code 7204 10 00); alloy steel scraps and crumbs of alloy steel: Stainless steel scarps (HS code 7204 21 00); alloy steel scraps and crumbs of alloy steel: Other scarps (HS code 7204 29 00); iron scraps and debris of iron or tin-coated steel (HS code 7204 30 00); scraps and other crumbs: Chips, shavings, debris, rolled scales, sawdust, filings, cutting chips and bavia, whether or not pressed into blocks or packed into bales, bundles (HS code 7204 41 00); scraps and other debris: Others (HS code 7204 49 00).

Plastic scraps and debris of plastic include: From polymers of ethylene: Porous, non-rigid form (HS code 3915 10 10); from polymers of ethylene: Others (HS code 3915 10 90); from polymers of styrene: Others: Styrene polymers (PS), Acrylonitrile Butadiene Styrene (ABS); High Impact Polystyrene (HIPS); Expanded Polystyrene (EPS) (HS code 3915 20 90);…

Paper scraps: Kraft paper or kraft board or corrugated paper/board, unbleached papers (HS code 4707 10 00); papers or other boards made mainly of pulp obtained from chemical process which are bleached, are not yet stained in its entirety (HS code 4707 20 00); papers or boards made mainly of pulp obtained by a mechanical process (for example, newsprint, magazines and similar publications) (HS code 4707 30 00).

Organizations and individuals that directly import scraps as raw materials for production may only import scraps as raw materials for production for their establishments according to their designed capacity to produce products and goods.

In terms of transition provisions, paper scraps with HS code 4707 90 00 that is allowed to be imported from abroad under a Component Environmental License (Certificate of eligibility for environmental protection in the import of scraps as raw materials for production) issued by the competent authority before June 1, 2023 may continue to be imported until the Component Environmental License is no longer valid.

Plastic scraps and scrumbs of plastics with HS code 3915 90 00 that are permitted to be imported from abroad under a Component Environmental License or an Environmental Permit issued by the competent authority before June 1, 2023 may continue to be imported until the Component Environmental License or the Environmental Permit is no longer valid, according to the corresponding HS codes specified in the List of scrap items permitted to be imported from abroad as raw materials for production promulgated with this Decision.

Scraps permitted to be imported from abroad under Component Environmental Licenses or Environmental Permits issued by the competent authorities before June 1, 2023 with different names (but HS codes unchanged) in comparison with the one(s) in this Decision shall continue to be imported until the Component Environmental License or the Environmental Permit is no longer valid.
